Agreement Between Guests and Sparks Lake Resort

Guests must review and accept all of the following as a condition of booking: Terms & Conditions Lake & Outdoor Activity Waiver Resort Rules & Safety This Privacy Policy If you do not agree to these required policies, you should not use the site or complete a reservation.

Welcome to Sparks Lake Resort ("Sparks Lake Resort," "we," "us," or "our"). These Terms and Conditions ("Terms") govern your access to and use of our website, your reservation, your booking, and your stay at Sparks Lake Resort.

This Website is provided solely to assist guests in obtaining information, checking availability, making legitimate reservations, and conducting business directly with Sparks Lake Resort. By accessing this Website, making a reservation, or staying at Sparks Lake Resort, you agree to be bound by these Terms. If you do not agree, please do not use the Website or make a reservation.

Eligibility & Guest Responsibilities

By using this Website or making a reservation, you represent and warrant that:

• You are at least 18 years of age;
• You have the legal authority to enter into a binding agreement;
• You are making reservations only for yourself or individuals you are authorized to represent;
• All information you provide is accurate, current, and complete;
• You will comply with these Terms and all posted resort rules and safety policies.

We reserve the right to deny service, cancel reservations, or restrict access to the Website for violations of these Terms or for any reason deemed necessary to protect our property, guests, staff, neighboring land, or operations.

Reservations & Payments

All reservations are subject to availability and confirmation. By completing a reservation, you authorize Sparks Lake Resort to charge the payment method provided for applicable lodging charges, taxes, fees, deposits, and incidentals as disclosed at booking.

Guests may be required to present a valid government-issued ID and a credit card or cash deposit at check-in to cover incidental charges, damages, cleaning issues, missing property, or policy violations.

Payment Authorization & Chargeback Protection

By completing a reservation, you authorize Sparks Lake Resort to charge your payment method for all lodging costs, taxes, fees, and any additional charges incurred during your stay.

You agree not to initiate a chargeback or payment dispute without first contacting Sparks Lake Resort to attempt to resolve the issue directly. Any unauthorized chargebacks may be subject to additional administrative fees, collection efforts, and/or legal action where permitted by law.

All confirmed reservations serve as proof of payment authorization and agreement to these Terms, together with our related policy pages.

Cancellation & Refund Policy

All reservations are subject to the following:

• Cancellations must be made at least 24 hours prior to check-in (3:00 PM CST).
• Cancellations within 24 hours may be charged up to one full night.
• No-shows will result in full forfeiture of the reservation amount.
• Early departures are not eligible for refunds.

Sparks Lake Resort reserves the right to enforce all cancellation policies regardless of reason, including weather, travel delays, or personal circumstances, unless otherwise required by law.

Refunds, if approved, are issued at the sole discretion of Sparks Lake Resort.

Group & Multiple Cabin Bookings

Online reservations are limited to a maximum of six (6) cabins for the same stay dates. Reservations exceeding this limit may be canceled. For group bookings of six or more cabins, guests must contact Sparks Lake Resort directly. Additional terms, deposits, and written agreements may apply.

Damages, Cleaning & Additional Charges

Guests are responsible for any damage to cabins, furnishings, equipment, boats, docks, amenities, grounds, or other resort property caused during their stay.

• Excessive cleaning fees may be charged if the cabin is left in poor condition.
• Missing or damaged items will be charged to the payment method on file.
• Unauthorized pets, smoking, or rule violations may result in additional fees.
• Lost, unreturned, or damaged outdoor equipment may result in replacement or repair charges.

By booking, you authorize Sparks Lake Resort to charge for any damages, violations, excessive cleaning, missing items, or unpaid balances identified during or after checkout.

Use of the Property & Assumption of Risk

Sparks Lake Resort is a natural, outdoor environment. Guests acknowledge and accept the inherent risks associated with outdoor and lake activities, including but not limited to:

• Fishing, boating, kayaking, canoeing, paddle boats, swimming, and dock use;
• Nature trails, uneven terrain, slips, falls, and wildlife encounters;
• Weather-related conditions, heat, rain, storms, and changing water conditions;
• Hazards associated with shorelines, wooded areas, neighboring land, the fountain, the dam, and the spillway.

Guests assume full responsibility for their safety and the safety of all members of their party, including minors. Life vests are required for all lake activities. Adult supervision of minors is required at all times.

Lake, Outdoor & Property Liability Waiver

Guests acknowledge that Sparks Lake Resort is a natural outdoor environment and agree to assume all risks associated with activities including, but not limited to: boating, fishing, swimming, dock use, trails, wildlife, wooded areas, changing weather conditions, and general lake access.

Sparks Lake Resort is not responsible for accidents, injuries, loss of personal property, or damages resulting from use of the property, lake, boats, docks, trails, parking areas, common areas, or surrounding outdoor spaces.

By staying at the Resort, you voluntarily accept all such risks and agree to hold Sparks Lake Resort harmless to the fullest extent permitted by law. Guests using lake equipment or participating in outdoor activities are also subject to the Lake & Outdoor Activity Waiver.

Prohibited Activities

Guests agree not to:

• Use the Website or property for unlawful or commercial purposes;
• Damage, alter, misuse, or remove resort property;
• Engage in disruptive, unsafe, threatening, reckless, or inappropriate behavior;
• Misrepresent identity or reservation information;
• Attempt unauthorized access to systems or data;
• Enter restricted areas, neighboring properties, or unapproved wooded areas;
• Ignore posted safety instructions or staff direction regarding the lake, dam, fountain, spillway, cabins, or common areas.

We reserve the right to remove guests from the property without refund for violations of these rules or related resort policies.

Right to Refuse Service

Sparks Lake Resort reserves the right to refuse service, cancel reservations, or remove guests from the property at any time without refund for:

• Violation of resort rules, safety rules, or waiver requirements;
• Disruptive, threatening, or unsafe behavior;
• Damage to property;
• Providing false information;
• Conduct that endangers guests, staff, neighboring property, or resort operations.

Third-Party Booking Disclaimer

Sparks Lake Resort is not responsible for reservations made through third-party platforms. Policies, pricing, terms, modification options, and refund procedures may differ and may be governed in whole or in part by those platforms.

Guests booking directly through our website receive the most accurate pricing, availability, and policy information published by Sparks Lake Resort.

Intellectual Property

All content on this Website, including text, images, logos, branding, design elements, and page layouts, is owned by or licensed to Sparks Lake Resort and may not be copied, reproduced, distributed, or used without written permission.

Limitation of Liability

To the fullest extent permitted by law, Sparks Lake Resort shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the Website, your reservation, your stay, or your use of the property. Our total liability shall not exceed the greater of the fees paid for your stay or $100, except where prohibited by law.

Indemnification

You agree to indemnify and hold harmless Sparks Lake Resort, its owners, employees, managers, representatives, and affiliates from any claims, damages, losses, liabilities, or expenses arising from your breach of these Terms, violation of law, misuse of the property or Website, or actions by you or members of your party.

Dispute Resolution & Arbitration

We are committed to resolving concerns amicably. If a dispute cannot be resolved informally, any claim arising from these Terms, your reservation, your booking, or your stay shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) under its applicable Consumer Arbitration Rules, except where small claims court is permitted by law.

Arbitration will be conducted on an individual basis only. The Federal Arbitration Act governs this agreement to arbitrate.

Privacy Policy

Your use of this Website is also governed by our Privacy Policy, which is incorporated by reference.

Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.

Entire Agreement

These Terms, together with any incorporated policies, constitute the entire agreement between you and Sparks Lake Resort regarding use of the Website, reservations, and your stay. If any provision is found unenforceable, the remaining provisions shall remain in full force and effect.
